Definitions
“ATM Engineering” means ATM Engineering S.r.l., a company based in Vicolo del Cardello n. 14, 00184 – Rome – Italy, with operational headquarters in Viale Castello della Magliana, 38 - 00148 - Rome - Italy. “Site” means the www.atmengineering.it website, managed by ATM Engineering, which is also its owner. “User” or “You” means any visitor to and/or user of the Site.
The various Site sections are managed by ATM Engineering, or by any third parties specified on a case by case basis. This agreement sets out the terms and conditions for using the Site, made available through the Site. The present terms and conditions shall set out and apply to the responsibilities of both the User and, together with other aspects, ATM Engineering. Before using the Site, carefully read the whole of this agreement. By accessing any part or section of the Site, the User undertakes to be bound by and observe and perform these terms and conditions. If you do no agree with any of the terms and conditions set out herein, you should refrain from using the Site.

Proprietary Information Notice
Users are reminded and acknowledge that the information, data, software, photographs, graphs, videos, graphical images, music, sounds, images, illustrations, drawings, icons and any other material posted on this Site are the exclusive property of ATM Engineering and/or any third parties. Therefore, the copying, reproduction, in whole or in part, downloading, saving, publication or circulation, by any means, and, generally speaking, the exploitation or use of any information or materials coming from this Site, in whatever form, through existing or future media and technologies, are prohibited, unless otherwise stated. The above matter is governed differently in the “PAKE” section, in accordance with the relevant NOTICE posted there and with the (CC) Creative Commons Attribution-Noncommercial-No Derivative Works 2.5 Italy.

Trade marks
“ATM Engineering” is a figurative and word mark and the registered property of ATM Engineering S.r.l., like all the logos used in the Site and registered as trade marks by ATM Engineering. Any third-party marks and logos mentioned in the Site are the exclusive property of the respective owners. The use or reproduction, in any form or manner, of the said marks and logos is prohibited.

Authorised use
Users may use the Site for legal and legitimate purposes only and not for speculation or fraudulent activities. It is forbidden to use any part or section of the Site, unless expressly authorised by ATM Engineering in writing, or unless otherwise stated, as well as the information or materials posted on the Site, including those that can be downloaded free of charge, for commercial or advertising purposes of any kind, or for illegal purposes.
Users must be of age (18 or older), or in any case old enough to undertake legal obligations and responsibilities, in connection with the use of the Site, and must in any case be older than 14 years, or else they must not access and use the Site. Users carrying out illegal or fraudulent acts shall be prosecuted in accordance with the law.

General limitations of liability
The information, software and services included in or available through the Site may be inaccurate or contain mistakes.
The information posted on this Site can change from time to time. ATM Engineering and/or its suppliers may at any time make improvements and/or changes to the Site and/or the services provided.
ATM Engineering and/or its suppliers cannot guarantee the appropriateness, reliability, availability, absence of viruses, or of other components capable of causing damage, and accuracy of the information, software, services and related graphics contained in this Site, or the services offered for any purpose whatsoever.
ATM Engineering and/or its suppliers shall not be held liable or responsible for any direct or indirect, moral, incidental, special or consequential damage, or any other kind of damage including, without limitation, loss of use, loss of data, loss of income or loss of profit arising directly or indirectly from, or in any way related to, the use or running of the Site, or of any services provided therein, any delays related to, or the impossibility to use, the Site and the services provided therein, the provision or failed provision of the services, or any information, software, service or related graphics obtained through the Site.
ATM Engineering shall not be held liable or responsible for any damage, loss or default arising from the services or sections of the Site that are not under its direct control.
ATM Engineering and its managers, employees or freelance collaborators shall not be held liable and responsible for any direct or indirect loss, claim or damage of any kind, even if arising from a contract or an unlawful act, under civil law, or in any other way related to the use of the Site in a manner that does not conform to the present terms and conditions, even if ATM Engineering has been informed about the possibility of such damage occurring.
If, notwithstanding the above, ATM Engineering is found liable for any loss or damage arising from the use of this Site, the User accepts and acknowledges that ATM Engineering’s liability shall not exceed the amount of the costs, if any, incurred by the User in connection with the use of the Site.

Links to other websites and services
ATM Engineering shall not be held liable or responsible for any third-party web sites accessed via links found in this Site, nor shall ATM Engineering be held liable or responsible for the information obtained by users from any web sites accessed in the above mentioned manner. ATM Engineering, in fact, cannot guarantee and accepts no liability for the completeness and accuracy of the contents and information provided by the third-party web sites.
ATM Engineering cannot guarantee and accepts no liability for the contents, availability, operation and formalities of any web site accessed via the links provided in this Site.
Moreover, third-party web sites may apply to ATM Engineering for a direct link to the home page of this Site. ATM Engineering, however, reserves the right to deny authorisation to link up with this Site if such a link might damage the company in any way (including damage to the company’s image and reputation), at its discretion. So-called deep links or links established by means of techniques aimed at preventing the recognition of (or concealing) the origin of the contents (framing) are expressly forbidden.

Third-party sections and contents
The Site also hosts sections, contributions, articles and, generally speaking, materials edited by or supplied to ATM Engineering by third parties. ATM Engineering, however, accepts no liability for the legality, truthfulness, completeness, or any other aspect, of the contents of any such materials or sections posted on the Site. Liability in respect of the contents of such materials or sections, including the ownership and legitimate use of the texts, images, photographs, music, videos, etc., contained therein, shall lie exclusively with the specified third party. Any legal actions, in respect of the contents of the materials or sections posted on the Site, shall be undertaken solely and directly against the relevant authors or editors.

Reports and complaints
ATM Engineering undertakes, based on a suitably motivated request received in writing or by email, to promptly remove any material posted on the Site and found to be the property of any person or entity other than the person or entity specified as the author of the material or the editor of the Site section, who can legitimately claim any rights or interest in the materials or the contents thereof, or if the material or its contents breaches or violates any interest or right protected by the law.

Closing down a service
ATM Engineering may end or suspend access by users to all or sections of this Site, at any time, without notice and at its sole discretion.

Entire agreement
These terms and conditions represent the entire agreement between the User and ATM Engineering, with respect to the use of the Site, and supersede any prior agreement or statement. The User, moreover, is informed that use of any sections of the Site shall be subject to further legal and/or contract provisions, as notified on the Site, on a case by case basis. ATM Engineering reserves the right, at its sole discretion, to alter and amend these terms and conditions at any time, and to notify the new terms and conditions by posting them on the Site, as a result of which they shall enter into effect and become legally binding. The use of this Site by the User shall be subject to the terms and conditions in force at the time of use.

Severability
The headings used herein are for convenience only and shall not in any way affect the construction or interpretation of these terms and conditions.
If any provision of this agreement is held to be entirely or partially invalid or impaired or invalidated in any way, because it is contrary to the applicable law, the other provisions shall continue to remain fully effective and in force.

Reserved rights
All the rights relating to the contents of this Site are reserved, in accordance with the applicable law. The reproduction, publication and distribution, in whole or in part, of the original materials posted on this Site is expressly prohibited without an authorisation in writing.

Language
The present terms and conditions shall be drawn up in Italian, English and French. In the event of any discrepancies between the two languages, and of doubts as to their interpretation, the Italian language text shall prevail.

Applicable law and jurisdiction
These terms and conditions shall be governed by and construed in accordance with the laws in force in Italy. Any disputes arising in connection herewith, or related hereto, shall be finally settled by the competent Courts of Rome, in Italy. Any matters not provided for herein shall be governed in accordance with the applicable laws.
